Labour Market Impact Assessment

Canadian Employers looking to hire Foreign Workers, Labour Market Impact Assessment (LMIA)

Canadian companies experiencing labour shortages are able to hire foreign workers if they are granted a Labour Market Impact Assessment (“LMIA”) from the Canadian Government.  This is known as the Temporary Foreign Worker Program.  We assist companies with the preparation of LMIA applications and with bringing skilled workers into Canada under the Temporary Foreign Worker Program.

The Canadian labour market is generally closed to foreign workers.  However, the Canadian Government does allow Canadian companies to hire foreign workers if the company can prove they cannot find sufficient staff within the Canadian labour market.

Our law firm assists Canadian companies bring skilled foreign workers into Canada under the Temporary Foreign Worker Program.  This is one of the primary areas of immigration law we focus on.  We have assisted many companies bring into Canada foreign-trained long-haul truck drivers, cooks, carpenters, painters, plasterers, glaziers, farm workers, general labourers, and many others.  Foreign workers are generally granted work permits for 2-3 years.

What is Labour Market Impact Assessment?

A Labour Market Impact Assessment (LMIA) is a document that an employer in Canada may require before hiring a foreign worker. A positive LMIA indicates that a foreign worker is necessary to fill the job position, and there are no Canadian workers or permanent residents available to perform the job. It is also known as a confirmation letter.

If the employer requires an LMIA, they must apply for it. Once they receive the LMIA, the worker can apply for a work permit.
