Convention Refugee and Protected Persons Claims

A Convention refugee is a person outside their home country or the country they reside in who is not able to return to that country because of a well-founded fear of persecution based on race, religion, political opinion, nationality or being part of a social group, such as women or people of a particular sexual orientation.

A person in need of protection is a person in Canada who cannot return to their home country safely. This is because, if they return, they may face danger of torture, risk to their life, or a risk of cruel and unusual treatment or punishment. These applications are extremely difficult and are generally presented in a hearing before the Refugee Protection Division.

For example, the lawyers at our firm were leading counsel when the MV Sun Sea arrived in Canada in August 2010 carrying 492 Tamil migrants escaping persecution in Sri Lanka after the Sri Lankan civil ended. These migrants put their lives in danger by sailing across the Pacific Ocean in a decommissioned, unseaworthy ship in order to find a safe shore in Canada.
